Websites Privacy Statement

The Swank Labs Games websites are operated by Swank Labs LLC (“Swank Labs,” “we,” “us,” or “our”). This Privacy Statement explains how information is handled when you visit our websites.

This Statement covers our websites only. How information is handled when you play the Switchback game on iOS or Android is described separately in the Switchback Privacy Statement.

What this Statement covers

This Statement applies to swanklabsgames.com and the pages we publish under it, including the Switchback pages (the “Websites”).

Our Websites are intended to be primarily static informational pages. You do not need an account to use them, we do not ask you to create one, and we do not sign you in. We do not use advertising cookies or marketing cookies on these pages, and we do not sell personal information.

Information handled when you visit

Website analytics

We use Vercel Web Analytics to understand how many people visit the Websites and which pages they view. It is designed to be privacy-friendly: it does not set cookies, does not store an identifier on your device, and does not collect the kind of persistent identifier that would allow a visitor to be tracked or cross-checked across other applications or websites. In place of a cookie, a visit is associated with a hash derived from the incoming request, and that visitor session is automatically discarded after 24 hours rather than stored permanently.

The following may be recorded with each page view:

• the time of the request;
• the page address and its route pattern;
• the referring website, if any;
• query parameters, filtered;
• an approximate location derived from the request, such as country, region, and city;
• operating system and version;
• browser and version;
• device type, such as mobile, tablet, or desktop; and
• the version of the analytics script.

We use this only as aggregated statistics about website traffic and do not use it to identify you. Vercel processes this information on our behalf under Vercel’s Privacy Policy.

Hosting and server logs

Our hosting provider, Vercel, may automatically process information necessary to deliver and secure the Websites, such as IP address, browser and device information, requested pages, timestamps, and security or server logs. This is separate from the analytics described above and happens as part of serving any page to you. This information is handled under Vercel’s Privacy Policy.

Fonts

Our pages use open-source typefaces that we host ourselves. Your browser requests the font files from our own Websites, the same way it requests a page, so no font provider receives your IP address or any other request information from your visit.

Information stored in your browser

Where we ask for an analytics choice, we record that choice in your browser’s local storage so we do not have to ask again on every visit. It stays on your device, is not sent to us as a cookie, and is not used to identify you.

Contacting us

Our Websites include links that open your email application so you can contact support. If you choose to send a message, we receive the email address used to send it, your message, any attachments you include, and any technical information you choose to provide. We use support communications to answer you, troubleshoot problems, improve our products, maintain appropriate business records, enforce our terms, and resolve disputes.

Please do not include sensitive personal information in support messages unless it is necessary for us to help you.

Links to other services

Our Websites link to third-party sites, stores, and social platforms, such as app storefronts and video or social accounts. We do not control those services. Information you provide to them, or that they collect when you follow a link, is governed by their own privacy policies.

Embedded video

The Switchback page includes a video that plays in place on the page. Nothing is requested from YouTube until you press play: the still image shown beforehand is served from our own Websites, so a visit that never plays the video makes no connection to YouTube at all.

If you do press play, the player is loaded from YouTube’s privacy-enhanced address, youtube-nocookie.com. Your browser then connects to Google, which receives your IP address and information about your browser, and may store information on your device in connection with playback. That is governed by Google’s privacy policy rather than this Statement. You can also watch the video on YouTube directly instead.

Your analytics choice

Outside the United States, we ask before loading website analytics. Until you accept, the analytics script is not loaded and no page view is recorded. If you decline, it stays that way and nothing is loaded on later visits either.

Inside the United States, website analytics loads without a separate prompt.

We work out which of those applies from your browser’s own time-zone setting, because that requires nothing to be sent or stored before you have made a choice. It is a rough signal rather than a precise location, and a traveller or someone using a VPN can be read the wrong way by it.

Regardless of where we think you are, if your browser sends a Global Privacy Control signal, or the older Do Not Track signal, we treat that as a decline: analytics is not loaded, you are not asked, and nothing is written to your browser.

Otherwise, your choice is remembered in your browser’s local storage. You can clear it at any time by clearing site data for our Websites in your browser, which will cause us to ask again where we ask. You can also block the analytics script with a content blocker or a similar browser privacy feature, and the Websites will continue to work normally.

How we use information

We use information described in this Statement to:

• deliver, operate, and secure the Websites;
• measure aggregated website traffic, such as how many people visit and which pages they view;
• understand which of our pages and announcements are useful, so we can improve them;
• respond to support requests and use feedback to improve our products;
• protect the Websites, Swank Labs, and our providers from fraud, abuse, and security threats;
• comply with law and enforce our agreements; and
• create aggregated or de-identified information that does not reasonably identify an individual.

We do not use website information to build advertising profiles, and we do not combine it with information from the Switchback game.

How information is shared

We disclose information only as described in this Statement, including to:

• Vercel: Our hosting and website analytics provider, which processes this information on our behalf.
• Communications providers: Such as our email provider, for support communications.
• Professional advisers and business service providers: When reasonably necessary for legal, accounting, security, or operational support and subject to appropriate duties of confidentiality.
• Authorities or other parties for legal and safety purposes: When reasonably necessary to comply with law, legal process, or enforceable governmental requests; protect rights, property, or safety; investigate fraud or abuse; or enforce our agreements.
• A successor or transaction participant: In connection with a merger, financing, acquisition, reorganization, bankruptcy, or sale of all or part of Swank Labs, subject to applicable law.

We do not sell personal information, and we do not share it for cross-context behavioral advertising or targeted advertising.

Legal bases for processing

Where applicable law requires a legal basis, we rely on:

• Consent: For website analytics where we ask for it. You may withdraw consent going forward as described under Your analytics choice.
• Legitimate interests: To deliver and secure the Websites, respond to support, measure aggregated website traffic, maintain appropriate records, prevent fraud, and operate our business, where those interests are not overridden by your rights.
• Legal obligations: To comply with applicable law, legal process, and enforceable requests.

Data retention

• Website analytics: The hash used to associate a visit is discarded after 24 hours and is not stored permanently. The resulting aggregated traffic statistics may be retained for longer because they do not identify you.
• Server logs: May be retained by our hosting provider for operational and security purposes according to its policies.
• Your analytics choice: Remains in your browser’s local storage until you clear your site data.
• Support communications: Are retained for as long as reasonably necessary to respond, maintain appropriate business records, improve our products, resolve disputes, enforce our agreements, and comply with legal obligations.
• Aggregated or de-identified information: May be retained for longer because it does not reasonably identify you.

We may preserve information for longer when reasonably necessary for legal compliance, fraud prevention, security, disputes, or enforcement of our agreements.

Children

Our Websites are general-audience informational pages and are not directed specifically to children under 13. We do not knowingly collect personal information directly from children under 13 through the Websites.

If we learn that we have collected personal information from a child under 13 in a manner that requires parental consent and did not receive that consent, we will take appropriate steps to delete or otherwise address the information. A parent or guardian who believes a child has provided personal information to Swank Labs may contact support@swanklabsgames.com.

International data transfers

Swank Labs operates from the United States. Vercel and our other providers may process information in the United States and other countries where they or their service providers operate. Those countries may have data-protection laws different from the laws where you live. Where required, we and our providers use recognized safeguards for international transfers.

Your privacy rights and choices

Depending on where you live, you may have rights to access, correct, delete, or obtain a copy of personal information; object to or restrict certain processing; withdraw consent; and appeal a decision regarding a privacy request.

Because our Websites do not use accounts and our analytics is aggregated and not tied to an individual, we typically hold no information that we can connect to you or locate by name. That limits what we can do in response to an access or deletion request about website visits specifically. We may need information from you to locate relevant support correspondence or verify a request, and we will not collect more information than reasonably necessary for verification.

You can exercise choices as follows:

• Accept or decline optional website analytics where we ask.
• Clear site data for our Websites in your browser to reset your choice and be asked again.
• Block the analytics script with a content blocker or similar browser privacy feature.
• Turn on Global Privacy Control in your browser, which we treat as a decline on every visit.
• Submit a privacy request or appeal to support@swanklabsgames.com.

If applicable, you may also complain to your local data-protection authority. We will not discriminate against you for exercising applicable privacy rights.

Security

We use reasonable administrative, technical, and organizational measures designed to protect information under our control. Our Websites are served over HTTPS. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

Changes to this Statement

We may update this Privacy Statement as our Websites evolve or legal requirements change. We will update the date above and, when appropriate, provide additional notice on the Websites. If we later add material features such as accounts, newsletters or mailing lists, advertising, or additional analytics, we will update this Statement before or when those features become available.
